The terms “we”, “us” and “our” refer to VASARI. VASARI operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”).

Our store is powered by Shopify, which enables us to provide the Services to you.

The following terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when using our Services.

Please read these Terms carefully, as they include important information regarding your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with, or purchasing from our website, you agree to be bound by these Terms of Service and our Privacy Policy available on our website.

If you do not agree with these Terms, you should not access or use our Services.


SECTION 2 – CONTRACT FORMATION

A purchase contract between the customer and VASARI is formed only when all of the following conditions are met:

The customer successfully submits an order through the website.
VASARI accepts the order by sending an order confirmation email.
The payment authorization has been successfully completed.

VASARI reserves the right to refuse or cancel any order for reasons including, but not limited to:

Stock unavailability
Pricing or listing errors
Suspected fraud or chargeback risk
Incomplete, inaccurate, or unverifiable customer information

No purchase contract exists until the order confirmation email has been issued.


SECTION 3 – PRODUCT INFORMATION

VASARI makes reasonable efforts to ensure that product descriptions, images, specifications, and pricing information displayed on the website are accurate and up to date.

However, minor variations may occur due to factors such as:

Manufacturing tolerances
Color display differences between devices and screens
Natural variations in fabrics, textures, and finishes

These minor differences are inherent to apparel production and do not constitute grounds for cancellation, refund, or claims of misrepresentation.


SECTION 4 – PRICING, TAXES AND DUTIES

Prices displayed on the website include applicable VAT for customers located within the European Union and the United Kingdom where required by law.

Duties and Taxes Policy — DDP

For certain regions, orders are shipped Delivered Duty Paid, also known as DDP, meaning duties and import taxes are already included in the price shown at checkout.

DDP regions include:

European Union
United States
Canada
United Kingdom

For all other destinations, customs duties, import taxes, and additional charges may apply according to the laws of the destination country and remain the responsibility of the customer unless otherwise stated at checkout.

If a shipment is refused or returned due to unpaid customs charges in non-DDP regions, the customer will be responsible for:

Return shipping costs
Administrative processing fees
Any applicable restocking deductions


SECTION 5 – PAYMENT TERMS

We accept major payment methods including:

Credit and debit cards
PayPal
Klarna
Shop Pay
Apple Pay
Other payment methods displayed during checkout

All transactions undergo automated fraud detection and security screening.

VASARI reserves the right to request additional verification or documentation before approving an order and may cancel any order that fails security checks.


SECTION 6 – ORDER PROCESSING AND DELIVERY

Orders are processed Monday through Friday, excluding public holidays.

Standard order processing time is 1–3 business days.

Some products may be offered as pre-order items, in which case the estimated shipping window will be clearly indicated on the product page.

Delivery timelines are estimates and may vary due to production schedules, customs processing, or carrier delays.

Unless otherwise required by mandatory consumer protection law, the risk of loss or damage transfers to the customer once the order is handed over to the shipping carrier.


SECTION 7 – RETURNS, REFUNDS AND RESTOCKING FEE

Returns may be requested within 14 days from the date the order is delivered.

To qualify for a return, products must:

Be unused, unwashed, and undamaged
Include all original packaging, tags, and accessories
Not belong to excluded product categories

Excluded categories may include:

Sale items
Certain accessories
Products clearly marked as non-returnable

Unless the item is defective, return shipping costs remain the responsibility of the customer.

Approved returns are subject to a 10% restocking fee.

Once the returned product is received and passes inspection, the refund will be issued to the original payment method.

VASARI reserves the right to refuse returns that do not meet the stated conditions.


SECTION 8 – EXCHANGES

To ensure product availability, exchanges are handled by placing a new order.

Customers who wish to change size, color, or item must place a new order for the desired product and return the original item in accordance with the Return Policy.

This process ensures faster fulfillment and prevents stock availability issues.


SECTION 9 – GIFT CARDS AND STORE CREDIT

Gift cards issued by VASARI are:

Non-refundable
Non-transferable
Not redeemable for cash

Orders purchased fully or partially using store credit issued from previous returns are not eligible for return.


SECTION 10 – CHARGEBACKS, FRAUD AND DISPUTE RESOLUTION

By placing an order on the website, the customer acknowledges and agrees to the following conditions.

10.1 Duty to Contact the Merchant First

Before initiating any chargeback or payment dispute with a bank or payment provider, the customer must first contact VASARI at:

info@vasariclo to allow the issue to be reviewed and resolved.

10.2 Fraudulent Chargebacks

The following actions may be considered fraudulent or abusive chargeback behavior:

Filing a chargeback while the item is still in transit
Filing a chargeback after the item has been delivered
Filing a chargeback without returning the product
Filing a chargeback due to delivery delays caused by the carrier
Filing a chargeback while refusing communication with the merchant

VASARI reserves the right to dispute any unjustified chargeback by providing evidence including, but not limited to:

IP address logs
Device identification data
Checkout acceptance logs
Order metadata
Tracking and delivery confirmations
Customer communication history
Warehouse scan records

10.3 Legal Basis for Merchant Protection

These Terms and the resulting purchase agreement are supported under applicable consumer and commercial regulations including:

EU Directive 2011/83/EU, Consumer Rights Directive
Regulation (EU) 2018/302, Fairness in E-commerce
UK Consumer Rights Act 2015
UCC §§ 2-602, 2-607, 2-609, United States
E-SIGN Act, legal recognition of digital contracts in the United States

By completing the checkout process, the customer forms a binding digital contract under the applicable legal framework.

10.4 Account Suspension or Termination

VASARI reserves the right to suspend or permanently close customer accounts involved in:

Fraudulent disputes or chargebacks
Excessive or abusive return behavior
Violation of these Terms of Service
Misuse of the website or related services
